IMPORTANT NOTICE — HEALTHCARE & AI DISCLOSURE

Symplicured is not a medical device, does not provide medical diagnosis, and is not suitable for emergencies. Outputs are generated by Artificial Intelligence ("AI") models and are for informational and educational purposes only. Users should seek medical attention from licensed healthcare professionals for diagnosis, treatment, or medical advice.

1. DEFINITIONS

For purposes of these Terms of Use ("Terms"):

“Symplicured”, “we”, “us”, “our” means Symplicured Pte. Ltd., a private limited company incorporated in Singapore.
“Service” means the Symplicured platform, website, mobile site, applications, APIs, AI models, and any tools, including symptom search, triage questions, informational outputs, voice/audio processing, and image processing features.
“User”, “you”, “your” means any individual or entity accessing or using the Service.
“Data” means any data submitted or generated by the Service, including text, audio, voice, images, health information, telemetry, analytics, and metadata.
“Health Information” means any information related to symptoms, conditions, history, clinical data, lifestyle, or other information that may constitute health or medical information.
“Third-Party Providers” means infrastructure, cloud, analytics, and AI vendors including but not limited to:
- Amazon Web Services (“AWS”)
- Supabase
- OpenAI
- Anthropic
- Google Gemini
- Amplitude, and
- other listed subprocessors.

2. ACCEPTANCE OF TERMS

By accessing or using the Service, you acknowledge that you:

(a) have read, understood, and agree to be bound by these Terms;
(b) are legally capable of entering into binding agreements; and
(c) are at least 16 years old.

If you do not agree to these Terms, do not access or use the Service.

3. REGULATORY STATUS & MOH LEAP SANDBOX

3.1 Not a Medical Device

Symplicured is not currently classified as a medical device under the Singapore Health Sciences Authority (“HSA”).

3.2 MOH LEAP Sandbox Participation

Symplicured has applied to participate in the Ministry of Health (“MOH”) LEAP Sandbox for healthcare innovation. Participation does not imply medical device classification, regulatory approval, or clinical validation.

3.3 No Medical Advice

The Service does not provide:

(a) medical advice,
(b) diagnosis,
(c) treatment recommendations, or
(d) emergency care instructions.

4. ELIGIBILITY

4.1 Age Requirement

The Service is intended for Users aged 16 years or above. Users under 16 may not use the Service.

4.2 Geographical Use

Users are responsible for compliance with local laws in their jurisdiction.

5. HEALTH AND EMERGENCY DISCLAIMER

5.1 No Emergency Use

The Service must not be used for medical emergencies. If you believe you are experiencing a medical emergency, seek clinical or emergency services immediately.

5.2 No Diagnosis or Treatment

Outputs are informational and not a substitute for professional diagnosis or treatment.

5.3 Professional Healthcare

Users should consult licensed healthcare providers for medical concerns.

6. AI-GENERATED OUTPUTS & LIMITATIONS

6.1 AI Generated Content

Outputs may be generated using AI models and may be incomplete, inaccurate, misleading, or incorrect.

6.2 No Guarantee of Accuracy

We make no warranties regarding accuracy, quality, completeness, or suitability.

6.3 User Responsibility

Users assume responsibility for evaluating outputs and making decisions.

6.4 Explainability & Variability

AI outputs may vary based on user inputs, model changes, or environment factors.

7. PERMITTED USE

Users may use the Service solely for:

(a) informational, non-commercial, personal purposes, and
(b) enterprise healthcare evaluation if expressly authorized.

8. PROHIBITED USE

Users must not:

(a) misuse the Service,
(b) reverse engineer models or code,
(c) extract training data,
(d) provide false or harmful medical data,
(e) interfere with system operation,
(f) use for diagnosis, telemedicine, emergency care, or clinical decision-making unless under approved enterprise agreements.

9. DATA PROCESSING & THIRD-PARTY PROVIDERS

9.1 Subprocessors

We rely on third-party providers for:

hosting (AWS),
authentication/db (Supabase),
analytics (Amplitude),
AI inference (OpenAI, Anthropic, Google Gemini).

9.2 Privacy Policy

9.3 No Ownership Claims on User Data

We do not claim ownership of uploaded or submitted data.

9.4 Cross-Border Data Transfers

Data may be transferred outside Singapore, including to the United States, EEA, and other jurisdictions.

10. INTELLECTUAL PROPERTY

All content, features, designs, software, trademarks, and models are owned by Symplicured or licensors.

11. HIPAA, GDPR, PDPA & SOC 2 ALIGNMENT

11.1 HIPAA-Ready (Non-Binding)

Symplicured is not currently a HIPAA Covered Entity or Business Associate but operates in alignment to support future HIPAA compliance pathways.

11.2 GDPR & PDPA Applicability

Users may have rights under GDPR (EU/EEA) and Singapore PDPA regarding health and personal data.

11.3 SOC 2 Alignment

Security controls are designed to align with SOC 2 best practices.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

(a) Symplicured is not liable for indirect, incidental, consequential, punitive, exemplary, or special damages.
(b) Symplicured is not liable for medical decisions, outcomes, or harm from relying on AI outputs.
(c) Liability is capped at S$100 or the amount paid by the User in the preceding 12 months (whichever greater).

13. INDEMNIFICATION

Users agree to indemnify Symplicured from claims arising from misuse of the Service.

14. TERMINATION

We may suspend or terminate access at any time.

15. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by Singapore law. Disputes shall be resolved by Singapore International Arbitration Centre (“SIAC”) arbitration in English.

16. CHANGES TO TERMS

We may modify Terms at any time and updates become effective upon publication.
